Terms of Service
These terms are the agreement between YesPage and anyone who creates an account (a sender) or opens, signs, or pays for a proposal sent through it (a signer). By using YesPage you agree to them. If you are using YesPage for a business, you confirm you can bind that business. Questions: hello@yespage.co.
What YesPage is, and is not
YesPage lets a business build a proposal from a template, send it as a web page, collect an electronic signature, and collect a deposit or balance. The agreement created when a signer accepts a proposal is between the sender and the signer. YesPage is not a party to it, does not review it, and does not guarantee that either side will perform. We provide the tool and the record.
Accounts
- Sign-in is by an emailed link or code. Keep your inbox secure; anyone who can read your email can sign in as you.
- You are responsible for what is sent from your account, including by other users you add on a paid plan.
- Give us accurate business details. Proposals, receipts, and certificates carry the business name you enter.
- One person, one account is fine. Creating many accounts to get around limits is not.
Electronic signatures
Signatures collected through YesPage are electronic signatures. Before signing, every signer sees the full proposal, the selected optional items, the total, and a consent statement, and must agree to sign electronically. We record the signer's name, email, typed or drawn signature, the time, IP address, and device, and a hash of the exact document signed, and we write all of it to an audit trail that cannot be changed afterward. A certificate of completion is emailed to everyone who signed.
Electronic signatures are recognized under the U.S. ESIGN Act, UETA, and similar laws elsewhere for most agreements. Some documents, such as wills and certain real estate instruments, have their own rules. The sender is responsible for deciding whether an electronic signature is appropriate for their agreement and for the contents of what they send. YesPage does not give legal advice.
Payments
- Card and bank payments run through Stripe. The sender connects its own Stripe account, and client payments go to that account, not to YesPage. Stripe's processing fees and terms apply to the sender.
- On the Free plan, YesPage charges a platform fee of 2% of each card or bank payment made through a proposal, deducted before payout. Pro and Business plans pay no platform fee.
- Refunds of client payments are between the sender and the signer. The sender issues them from YesPage or Stripe; when a refund is issued, YesPage refunds its share of the platform fee.
- Payments recorded by the sender as cash, check, or transfer are the sender's statement. YesPage did not process them and cannot verify them.
- Paid plans are billed monthly or yearly in advance by card through Stripe. You can cancel any time from the billing page; the plan stays active until the end of the period already paid, and the account then returns to Free with everything intact. Yearly plans are not refunded for unused months.
Text messages and email
Senders may ask YesPage to email or text a signer only about a proposal that signer requested or reasonably expects. By entering a client's mobile number, the sender confirms the client agreed to receive texts about the proposal. Every message includes a way to stop. Using YesPage to send marketing, cold outreach, or anything unrelated to a specific proposal is not allowed and will get an account closed.
Acceptable use
Do not use YesPage to:
- send proposals to people who did not ask for them, or to addresses and numbers you do not have permission to contact;
- impersonate another business or person, or put someone's name on a proposal they did not send;
- collect payments for goods or services you do not intend to provide, or for anything illegal or prohibited by Stripe;
- upload content you do not have the right to use, or anything that infringes, defames, or harasses;
- probe, overload, or interfere with the service, or attempt to alter an audit trail.
Every proposal page has a report link. We investigate reports and may suspend an account while we do.
Your content
What you put into YesPage stays yours: proposals, templates, logos, photos, reviews, contacts. You give us permission to store, display, send, and render it as needed to run the service, including producing PDFs and certificates and showing proposals to the signers you choose. Public templates that we provide are ours; your copies of them are yours to edit and use.
Records and the badge
Signed proposals, signatures, audit trails, PDFs, and certificates are kept for seven years from signing and stay available to signers through the verification page even if the sender's account closes. On the Free plan, client pages and signed PDFs carry a small “Sent with YesPage” line. Paid plans remove it.
Availability and changes
We work to keep YesPage available and to fix problems quickly, but it is provided as is, without a promise of uninterrupted service. We may change features, and we will give reasonable notice before removing anything that a paid plan includes. We may change these terms; the date at the top changes and account holders are emailed when a change matters.
Disclaimers and limits
To the fullest extent the law allows, YesPage is not liable for indirect, incidental, or consequential damages, for lost profits, or for disputes between a sender and a signer, including non-payment or non-performance of the work described in a proposal. Our total liability for any claim is limited to the amount you paid YesPage in the twelve months before the claim, or one hundred dollars if you paid nothing. Nothing here limits liability that cannot be limited by law.
Ending things
You can close your account at any time from the app or by emailing us. We can suspend or close an account that breaks these terms, with notice where practical. Sections about records, payments already made, your content, and limits on liability survive closure.
Law and contact
These terms are governed by the laws of the U.S. state in which YesPage's operating entity is organized, without regard to conflict of law rules, and disputes are resolved in the courts located there. Contact: hello@yespage.co. See also the Privacy Policy.
